Brenner was prompted to create the Catastrophic Injury Resource Center after observing how many of his clients were substantially uneducated about their medical condition and their legal rights. Catastrophic injury refers to brain, spinal cord, and amputation injuries. Brenner’s Web site estimates that every year there are 12,000 new spinal cord injuries, 135,000 new amputations, and a striking 1.4 million people suffer from brain injuries.
These types of injuries can be severe. Spinal cord injuries are either complete or incomplete. “A complete spinal cord injury,” says Brenner “results in the loss of feeling and the inability to control one’s movement below the injury site. A person with an incomplete spinal cord injury is typically better off, but nerve damage is usually prevalent and movement is restricted.” Most people with spinal cord injuries are no longer able to work and have trouble performing functions that healthy people take for granted.
Brenner’s catastrophic injury practice also provides legal assistance to victims of brain and amputation injuries. Brain injuries, also referred to as Traumatic Brain Injury (TBI), range in severity from mild to moderate to severe. Long-term symptoms of a severe brain injury include slurred speech, loss of coordination, and seizures. “Amputations,” according to Brenner,” can be just as devastating—the loss of one’s limb alters a person’s life and may alter their ability to earn a living.”
Many catastrophic injury victims and their families worry about how to pay for medical expenses, and in cases where the injured person was the primary worker, paying household bills becomes a concern. “Most people don’t earn enough money,” says Brenner, “to support a loved one with this type of injury.” It may cost thousands of dollars every year to sustain medical treatment. In one’s lifetime, the cost could exceed a million dollars. “Most people just don’t have this kind of money lying around.”
Many victims of a catastrophic injury are entitled to compensation. Workers’ compensation benefits are often available to individuals injured in a work-related accident. When a catastrophic injury is the result of someone’s carelessness, other compensation may be available. “It’s definitely rewarding,” says Brenner, “when I can help a person suffering from a catastrophic injury live a better life.”
