The term of a copyright in literary, dramatic, musical work is sixty years from the death of the author of the copyright.
In case of cinematograph film, sound recording or photograph, the copyright lasts for sixty years from the date of publication.

Kolkata; Feb 5, 2011:LG Electronics has filed a complaint with the US International Trade Commission (ITC) claiming that their patent for the playback of Blue Ray Discs has been infringed by Sony. LG Electronics has stated in their complaint that the Sony’s Playstation 3 should be barred from entering the United States. A similar complaint was made by LG against Sony’s Bravia Television Sets.
This may be retaliation by LG against a complaint by Sony to the ITC against LG’s Smart Phones. The Complaint by Sony resulted in an investigation by the ITC. For more details please log on to http://www.iplawsindia.com
India refuses HIV Drug Patent
A drug to fight HIV by Abbott Laboratories has not been granted exclusive rights by the Indian Patent office. The patent was refused on the ground of lack of inventive step in the process of manufacture of the drug. The pricing of the drug had led to Abott losing exclusive rights to manufacture the product in some other countries as the drug was very highly priced. This means that in India cheaper generic alternatives might become available if Abott Laboratories does not appeal.

Microsoft opposes Apple trade mark
Microsoft has opposed Apples Trade Mark “Appstore” which was filed by Apple in the year 2008.The mark has been registered in the United Kingdom in 2009.Microsoft opposed the trade mark on the ground that app is generic for software applications and store is generic for retail store services.
Microsoft further claims in its motion that the registration of the mark would mean that competitors would be restrained from using the mark for application retail stores for a trade mark that they consider to be generic.
Tamiflu patent challenged
The patent for Tamiflu, a drug used to treat bird and swine flu, has been challenged by Natco Pharma Limited, a company based in Hyderabad, India . Tamiflu was originally invented by Gilead, a firm based in California. Natco Pharma has challenged the Patent by filing an Abbreviated New Drug Application (ANDA) with the US FDA .
Gilead now has a period of 45 days to respond by filing an infringement suit.
