Section 265-A2>

It’s against law to operate and/or attempt to drive an OHRV in the state under the influence of intoxicants such as alcohol, drugs, or a combination thereof with a blood alcohol concentration (BAC) equal to or greater than 0.08%.

Also it isn’t essential that a person stopped on suspicion show signs of impairment, but when the person's BAC is above the legal limit it can get him/her arrested and be booked under DUI in NH. Also even when the person’s BAC level is under the legal limit, a person may still have DWI offense charged if he/she should be displaying signs of impairment that conform to the DUI.”

The penalties include:

First time DWI offenders

* Jailfor a minimum time period of 10 days (in case of aggravated DUI)
* Fine of $500-750 (in case of aggravated DWI)
* Have thelicense suspended for 9 months to 2 Years, and in case of aggravated DWIthe license will be suspended for about 18 months to two years
* Asked to undergo CIDI (Complete Impaired Driver Intervention) program with probability for alcohol or drug treatment (or even both) and counseling
* SR22 insurance for 3 years.

Second time DWI offenders

* Should a person be convicted of DWI before 2 years of his/her first DWI conviction, he or should serve a minimum of 30 days in jail
* Stay in any of the multiple DWI Offender intervention detention center for 7 days straight (expenses borne by the convict)
* If convicted after 2 years and less than 10 years of first conviction, serve in jail for 3 days
* Serve 7 days in multiple DWI offender intervention detention center
* minimum fine of $750
* License suspension for a period of minimum 3 years and probability for ignition interlock besides alcohol and drug treatment and counseling
* SR22 insurance for 5 years.
