San Jose, CA, August 05, 2010 -- The Federal District Court in the Northern District of California entered judgment of copyright infringement against defendant Chordiant Software, Inc. (“Chordiant”). On May 14, 2010, a unanimous jury found that Chordiant infringed the copyrights in four PowerRPC and JRPC software technologies developed by plaintiffs Dr. Dongxiao Yue (‘Dr. Yue”) and Netbula, LLC. The jury awarded actual damages as well as Defendant’s profits attributable to infringement. After the jury trial, Chordiant filed numerous motions seeking to alter or overturn the jury’s decision. In its newest ruling, the U.S. District Court denied all of Chordiant’s post-trial motions. The Court issued judgment in favor of Plaintiffs.
"Legal protection of intellectual property is the lifeblood of the IT industry,” a Netbula spokesperson said. "We will continue to vigorously defend our intellectual property rights under the U.S. and international laws." Plaintiffs request those who copied the infringing products to preserve documents relevant to Plaintiffs’ claims.
Attorneys Antonio L. Cortes of the Law Offices of Antonio Cortes, Peter W. Ross and Peter Shimamoto of Browne Woods George LLP represented the Plaintiffs. Jedediah Wakefield and Laurence Pulgram of Fenwick & West LLP were lead defense counsel. Shawn Hoyt, Vice President and General Counsel of Pegasystems Inc., the parent corporation of Chordiant, filed a declaration in support of the Defendant.
The copyright case was presided over by U.S. District Judge the Honorable James Ware.
